Samuelson, Fatino, and Gral Successfully Appeal Housing Matter Before Iowa Supreme Court
Attorneys Jaki K. Samuelson, John F. Fatino, and Nicholas G. Gral recently prevailed in a decision before the Iowa Supreme Court. The case addressed a matter of first impression in Iowa. The issue in the case was what conduct constituted “steering” by a landlord and other matters which concerned fair housing issues. The Iowa Supreme Court had retained the case for resolution which bespeaks the novelty of the issues involved. The decision reversed a jury verdict which had found housing discrimination and which had imposed a $50,000 fine. Consequently, the Court dismissed the charges as insufficient on the record and sent the case back to district court for a determination of attorney fees in favor of the landlord.
